In early February, the U.S. Food and Drug Administration (FDA) issued a letter of enforcement discretion explaining that the agency would not object to “no artificial colors” and similar voluntary labeling claims, provided the food contains no certified colors.  A food that contains non-certified colors would be eligible for the claim under the FDA policy.  What does this enforcement discretion mean for your company?  This webinar, presented by our outside legal counsel Veronica Colas at Hogan Lovells, will explore the practical implications of FDA’s new policy, as well as related issues of how courts have treated past instances of FDA enforcement discretion.
