Bridgewater Dairy Drops Lawsuit Attempting to Block Make Allowance Change

IDFA was pleased to learn Friday that Bridgewater Dairy, represented by attorney Ben Yale, has dropped its lawsuit challenging the U.S. Department of Agriculture's (USDA) decision to increase Federal Milk Marketing Order make allowances. The lawsuit was filed in January; last month, the Toledo federal district judge denied Yale's request for a preliminary injunction against the implementation of the increases, which went into effect March 1. IDFA had filed a legal brief and participated in oral argument in successful opposition to that preliminary injunction motion. The decision to withdraw the lawsuit means the plaintiff will not pursue the claim further in the courts, effectively bringing the legal challenge to a close.
