Last week IDFA filed a Motion for Summary Judgment in its lawsuit against the state of Ohio, which claims the state's restrictive dairy labeling regulations violate members' right to commercial free speech and interfere with interstate commerce. This motion asks the court to issue a decision on IDFA's request for an injunction to stop the implementation of the labeling regulations, claiming there are no genuine issues of material fact. The state will have until August 15 to reply. Earlier this month, the judge consolidated IDFA's lawsuit with a similar one filed by the Organic Trade Association and ruled that implementation of the Ohio regulation would be delayed until 90 days after the court issues its decision.
