    Dairy Not Included in China’s Proposed Retaliatory Tariffs

    The U.S. Trade Representative on Tuesday released its proposed list of Section 301 tariffs on Chinese goods. If implemented, a 25 percent duty would be placed on 1,300 tariff lines amounting to $50 billion worth of Chinese goods. Public comments on the recommended tariffs are due May 11. The Section 301 Committee will hold a public hearing on May 15, and post-hearing comments are due May 22. China responded yesterday with its proposal to levy retaliatory tariffs of 25 percent amounting to $50 billion worth of U.S. goods including soybeans wheat, corn, cotton, sorghum, tobacco and beef.     Gottlieb Outlines FDA Nutrition Strategy, Affirms Several IDFA Priorities

    The head of the Food and Drug Administration last week affirmed the importance of several of IDFA’s regulatory priorities when he announced a multi-year nutrition strategy plan for the agency. Speaking at the Consumer Federation of America’s National Food Policy Conference in Washington, D.C., FDA Commissioner Scott Gottlieb, M.D., said FDA is reexamining food standards of identity to consider marketing trends and new nutrition science, and its goal is to maintain the basic nature and nutritional integrity of food while allowing flexibility for industry innovation. He highlighted dairy standards, including the agency’s work on modernizing the yogurt standard to support innovation, and noted that cheese standards prevent some cheesemakers from innovating with sodium substitutes. “It’s clear that our priorities and concerns about the need for standards modernization have resonated with this administration,” said Cary Frye, IDFA senior vice president of regulatory affairs.

    New USTR Report Identifies Burdens to Dairy Trade

    The Office of the U.S. Trade Representative (USTR) last week issued its annual National Trade Estimate Report, outlining many tariff and non-tariff barriers, including protective measures and technical obstacles to trade, that U.S. dairy companies face around the world. In October, IDFA submitted comments to USTR highlighting difficulties related to trade that the U.S. dairy industry faces specifically in Canada, the European Union, India, Indonesia and Russia. Several of these issues were captured in the report.

    USDA Recommends California FMMO, Begins Producer Referendum

    The U.S. Department of Agriculture published on Tuesday a final decision to recommend the establishment of a Federal Milk Marketing Order (FMMO) for California. The proposed FMMO is subject to producer approval by referendum, which opened on Tuesday, April 2, and will conclude May 5. The FMMO would become effective if it’s approved by two-thirds of the voting producers or by producers of two-thirds of the milk represented in the voting process. California represents more than 18 percent of all U.S. milk production and is currently regulated by a state milk marketing order.

    USDA Reopens Enrollment for Dairy Margin Protection Program

    USDA Secretary Sonny Perdue on Tuesday announced that the department would reopen enrollment in the Margin Protection Program for Dairy (MPP-Dairy). MPP-Dairy pays participating dairy farmers when the difference between the national all-milk price and the national average feed cost, or the margin, falls below a certain dollar amount elected by the producer. The program terms for MPP-Dairy coverage were changed by Congress as part of the recently enacted Bipartisan Budget Act of 2018 which funds federal government operations through September 30, 2018. IDFA has expressed strong support for the MPP-Dairy program changes that were included in the funding package, including a separate provision that would eliminate the funding cap for USDA underwriting costs associated with livestock insurance products.

    IDFA Calls for Dietary Guidelines Committee to Review Full-Fat Dairy Research

    Officials in the Departments of Agriculture and Health and Human Services (HHS) last month asked for stakeholder input on proposed priority topics and related scientific questions that the Dietary Guidelines Advisory Committee (DGAC) will consider when making recommendations for the updates to the Dietary Guidelines. In comments submitted last week, IDFA urged the departments to consider research related to the role of milkfat in a healthy diet. “A growing body of emerging research has shown the role of milkfat in the diet and health is different from saturated fats from other sources,” IDFA said, adding that the number of studies on milkfat has expanded since the advisory committee’s scientific review for the 2015 guidelines.

    ‘Dairy Delivers,’ IDFA’s Economic Impact Tool, Looks at Oklahoma

    The dairy products industry in Oklahoma employs more than 10,000 skilled individuals, generates more than $331 million in direct wages and has an overall economic impact of $4.58 billion. The state’s dairy companies ranked 32nd among the 50 states, the District of Columbia and Puerto Rico in contributions to the U.S. gross domestic product in 2017, according to IDFA’s economic impact tool, Dairy Delivers.

    IDFA Recognizes Rep. Billy Long for Efforts on CURD Act

    IDFA hosted a luncheon fundraiser for Rep. Billy Long, R-Mo., last week in Washington D.C., honoring the congressman’s years of service and recognizing his recent efforts to help preserve the term “natural cheese.” Long was a lead sponsor of the Codifying Useful Regulatory Definitions (CURD) Act (H.R.4828), which seeks to set a standard definition for ‘natural cheese’ within the Federal Food, Drug and Cosmetic Act. “Defining the term is good for the consumer and good for the industry. It maintains transparency and consistency for shoppers so that they will know what they are buying in the grocery store,” said Michael Dykes, D.V.M., president and CEO, who attended the luncheon.

    Trump Asks to Extend TPA, Affirms Interest in Pursuing Trade in Asia

    President Donald Trump last week asked Congress to extend Trade Promotion Authority (TPA) for three more years, a move that would allow new or renegotiated trade pacts to pass through Congress with an up-or-down vote and no amendments. In a letter requesting the extension, the president listed ongoing talks on the North American Free Trade Agreement (NAFTA) and the potential for new trade agreements in Southeast Asia, which are two areas of significant interest for IDFA members. Several administration officials last week also affirmed the importance of pursing trade agreements in the Asia-Pacific region, where demand for dairy products is rising rapidly.

    Chile Opens Investigation on Dairy Imports

    The Chilean government this month initiated an investigation to determine if imports of whole dry milk, non-fat dry milk and gouda cheese represent a threat to Chile’s domestic dairy industry. The United States is the largest exporter of non-fat dry milk to the country, representing 76 percent of Chile’s market share for the dairy ingredient. U.S. dairy companies exported more than $25 million worth of the non-fat dry milk last year to Chile. IDFA expects investigators to release recommended provisional measures to the president of Chile this week.

    UPDATE: FDA Clarifies Additional Details for Blue Cheese Sampling Assignment

    IDFA has learned from Food and Drug Administration officials that FDA will only test for Listeria monocytogenes in its new sampling assignment for blue cheeses. FDA has already started testing and is planning to collect approximately 200 samples of packaged product from retail stores as well as production and storage facilities. FDA will be testing both domestically produced and imported blue cheeses.

    IDFA Brings Dairy Cheer to National Nutrition Month

    It’s the last week of National Nutrition Month, and IDFA is looking back at highlights from its online celebration. IDFA shared fun facts about the nutritional benefits of dairy foods on Twitter, Facebook and Instagram and participated in social media chats with the Academy of Nutrition and Dietetics and nutrition experts. During School Breakfast Week, March 5-9, IDFA recognized the important nutrients dairy products bring to school meals. IDFA also honored the work of Michelle Matto, R.D.N., IDFA nutrition and labeling consultant, on March 14 for Registered Dietitian Nutritionist Day.
